1. The question arises how to distinguish British subjects from other persons, to which I shall recur hereafter.
2. It seems that Dr. Mercer, while administering the Convention, claimed the rendition not only of British subjects but of Chinese subjects who had committed crimes in British territory. This claim (according to European notions of international law) is quite untenable.
All that can be asked is that these persons should be punished by the Chinese Court. In support of this claim, one may urge Clause XVI of the treaty (which Dr. Mercer and his Attorney General unwisely attempt to limit in its construction), and there is no reason to apprehend difficulty from the Chinese Court.
But there they will enquire and punish barbarously, which makes it unpleasant to invoke their assistance.
